Terms of service

These terms govern AVENPORT pilot workspaces and paid monthly subscriptions. They apply from 1 August 2026.

1. Operator and contact

AVENPORT is operated by Kendel Gimie, Lehenmattstrasse 137, 4052 Basel, Switzerland. Contact: hello@avenport.ch.

2. Business service

AVENPORT is intended for businesses, professional sellers and people acting for a commercial purpose. You confirm that you may enter into the subscription for the organisation shown during checkout.

3. Service

The service provides public-page readiness scans, saved product records, evidence checklists and pilot workflow features. Scan results are automated estimates based on visible information. They are not legal advice, certification or a guarantee that a product may be sold in a market.

4. Contract and checkout

You select a plan, enter the requested details and review the price and billing period in Stripe. The contract starts when you confirm the subscription in Stripe. You can correct the checkout details before that confirmation. AVENPORT sends an electronic confirmation after successful payment.

5. Subscription and cancellation

Paid plans renew monthly until cancelled. You may cancel future renewals at any time through the Stripe customer portal. Cancellation takes effect at the end of the paid billing period; access continues until then unless the service is terminated for misuse.

6. Prices, tax and payment

The checkout shows the currency, recurring monthly price and any tax collected by Stripe before confirmation. Payment is processed by Stripe. AVENPORT does not receive full card or bank details.

7. Refunds

Paid periods are normally non-refundable once service access has been provided. This does not limit mandatory rights. If AVENPORT cannot provide the paid service for a material part of a billing period, contact hello@avenport.ch so an appropriate credit or refund can be reviewed.

8. Customer responsibilities

You must use public URLs you are entitled to process, provide accurate account and billing information, protect access to your account and review results before relying on them. You remain responsible for product safety, regulatory decisions and information published to sales channels.

9. Acceptable use

Do not use AVENPORT to access private systems, evade technical restrictions, overload third-party websites, upload unlawful content or interfere with the service. We may rate-limit or suspend abusive use.

10. Availability and pilot changes

The pilot may change as features are improved. We aim for reliable operation but do not promise uninterrupted availability. Material reductions to a paid plan will be communicated before the next renewal where reasonably possible.

11. Intellectual property

AVENPORT and its software, design and branding remain the property of the operator. You retain rights in information you provide. You grant AVENPORT the limited permission needed to process that information and deliver the service.

12. Liability

Each party remains liable where liability cannot legally be excluded. Otherwise, AVENPORT is responsible only for direct loss caused by a material breach and not for indirect loss, lost profit or decisions made without appropriate professional review.

13. Data protection

Personal data is handled as described in the AVENPORT Privacy Policy. Stripe processes payment information under its own terms and privacy notice.

14. Changes and termination

We may update these terms for future use of the service. Material changes affecting an active paid subscription will be announced in advance. Either party may terminate for a serious breach that is not corrected within a reasonable period.

15. Law and venue

Swiss law applies, excluding conflict-of-law rules. Courts in Basel, Switzerland have jurisdiction, subject to any mandatory jurisdiction or rights that cannot be waived.
